The High Court sought response from the Gandhis, AICC general secretary Oscar Fernandes, Suman Dubey, Sam Pitroda, Young India (YI) on the plea of BJP MP Subramanian Swamy challenging the trial court's decision and the National Herald case.
Advocate Satya Sabharwal, appearing for the BJP MP, and advocate Tarannum Cheema, appearing for the Gandhis, confirmed the issuance of the notice and adjourned the hearing till April 12.
The trial court has taken into consideration the plea of Subramanian Swamy under Section 244 of the Criminal Procedure Code (CrPC) before the evidence is examined Subramanian Swamy has called the Secretary General (Registry Officer), Deputy Land and Development Officer, Deputy Commissioner of Income Tax, etc of the Supreme Court as witnesses in his favour and asked them to produce the necessary documents related to the case.
The BJP MP has accused Gandhi and others of criminal breach of trust by showing only Rs 50 lakh as exchange value for National Herald when they were in power, through which Young India Pvt Ltd (YI) was able to recover Rs 1 crore that belonged to Congress'National Herald.
However, the accused chiefs, namely Sonia Gandhi, Rahul Gandhi, AICC Treasurer Motilal Vohra, AICC General Secretary Oscar Fernandes, Suman Dubey, Sam Pitroda and Young India (YI) have all denied the allegations.
