The petitioner's counsel Maneka Guruswamy told the Supreme Court in this regard that "we would like to recognise NOTA more broadly, that is, if the NOTA votes cast in a constituency are more than the number of votes cast, it does not mean the choice of candidates given by the local residents of that constituency, in which case the majority should be given importance and re-polling should be done.

In this context, Chief Justice of India SA Bobde, Justice AS Bopanna, Justice V Subramaniam noted that "the nullification of a seat would leave the seat vacant in Parliament or the Legislative Assembly " Reiterating that " the problem is essentially a constitutional one and the acceptance of the petition would leave the seat unrepresented and one seat vacant, thus creating the possibility of a breakdown of parliamentary democracy.
